CONE · cone-platform-2026-10-14-r205
Terms and Conditions
These terms govern the platform-use agreement between Sumexia GmbH, Bahnhofweg 17, 5610 Wohlen, Schweiz / Switzerland (UID CHE-236.998.154; Commercial Register No. CH-400.4.458.196-2), and users of CONE. Contracts for individual offers are generally formed solely between the users or organizations displayed in the transaction.
Effective date: 2026-10-14
1. Operator, operating rights and platform role
The operator and contracting party for CONE platform services is Sumexia GmbH, Bahnhofweg 17, 5610 Wohlen, Schweiz / Switzerland, UID CHE-236.998.154; Commercial Register No. CH-400.4.458.196-2. Sumexia GmbH operates CONE under contractually granted operating and usage rights. This does not state that the operator owns every trademark, software component or item of content.
CONE provides technical tools for listings, community features, communication, discovery, live/short sales and payment flows. Unless expressly displayed otherwise for a transaction, Sumexia GmbH is not the seller, buyer, landlord, employer, organizer, manufacturer, importer or agent of a user party. Use creates no partnership, agency, employment, franchise or fiduciary relationship between the operator and users.
2. Eligibility, accounts, identity and organizations
An account may be used only by a person with legal capacity or with valid consent from a legal representative. Payment- or contract-related actions generally require the user to be an adult. Information must be accurate and current; credentials must be kept confidential and suspected misuse reported promptly.
A deletion request can start only after open deals, payments, disputes, payouts, wallet balances and other outstanding obligations have been completed or cleared. Once accepted, the request locks the account immediately and hides its profile, listings and public activity. The account state at the time of the request remains recoverable for exactly 90 calendar days. Cancellation requires the existing credentials, a one-time link sent to the already verified email address and another password confirmation. Recovery ends irrevocably after day 90. A legal duty, settlement step or documented legal hold may extend only purpose-limited retention of required evidence, not account recovery.
An organization exists independently of any individual member. Its last active owner may delete the personal account only after ownership has been transferred to another verified account or open platform deals and payments have been completed. Sale, succession, dissolution, liquidation or insolvency may be recorded, corrected and withdrawn as a self-declaration. Evidence must be provided where required for a transaction, payout, risk review or mandatory law.
A self-declaration alone blocks neither access nor all activities. Individual transactions may be restricted only for concrete outstanding obligations, abuse, safety or payment risks; existing contracts, payments, refunds, disputes, payouts and mandatory retention duties remain in force.
Anyone acting for an organization represents that they have authority for the specific action. CONE records the human account, organization, role, permission state and time. The organization grants and revokes permissions; a later role change does not rewrite an authority or contract record already stored.
3. Listings, user content and rights
Providers alone are responsible for legality, accuracy, currency, product safety, title or authority to dispose, media rights and all mandatory disclosures. Deceptive, discriminatory, unlawful, counterfeit, recalled or prohibited content and products are forbidden.
Users keep ownership of their content. For the duration and purpose of platform use, they grant Sumexia GmbH a non-exclusive, worldwide, royalty-free and sublicensable license to technically store, reproduce, format, translate, display publicly and distribute that content within CONE to operate and promote the relevant listing. The license ends after removal except where backup, evidence or legal retention is required.
Rights-infringement notices may be sent to info@cone24.com with the exact location, ownership basis and contact details. CONE may temporarily disable content, request a response or counter-notice and restrict repeat infringers. Honest reviews and criticism may not be prohibited merely because of their content.
4. Contracts between users
The seller or provider, and therefore the contracting party for an individual offer, is solely the person or organization displayed in the transaction. Verification, trust or safety labels are not an operator guarantee of identity, title, quality, safety, legality, solvency or performance.
Offer, acceptance, handover, withdrawal and return rights, warranties, taxes, insurance and performance are governed by the parties’ agreement and mandatory law. These terms do not exclude mandatory consumer rights.
A fixed-price action expressly labeled “Buy now” forms a binding contract between the displayed parties when confirmed. Unique items and their related live or short sale close immediately; declared inventory is reduced, while an offer expressly marked as made-to-order remains open within its stated capacity.
Where a person acts for an organization, the human account remains recorded as the actor and the displayed organization is the contracting party.
5. Prices, auctions, payments and taxes
Prices, currencies, commissions, conversion and ancillary charges must be shown clearly before a binding action. Users are responsible for their own tax, customs, licensing and reporting duties. An auction may not be retroactively changed to another sale type after it begins. CONE collects no participation or auction deposit unless expressly displayed and accepted in advance.
A bid validly submitted under the displayed rules is binding. From the first active bid, neither bidder nor seller may start account deletion until the auction, payment, handover, refund and any dispute are completed or validly cancelled. Account deletion does not extinguish a contractual duty.
Under a direct arrangement, buyer and seller are responsible for payment, reservation, refund and handover; CONE holds no funds. With Cone SafePay, only the displayed licensed payment provider processes the payment. Its identity, sanctions, fraud, reserve, refund and chargeback rules may also apply.
The CONE wallet displays only payment states and claims. Real funds remain with a licensed payment or crypto partner. CONE is not a bank, holds no proprietary customer currency inventory, and does not buy or sell currency or crypto from its own stock. Organization proceeds go only to the verified payout route of the contracting organization, not an employee’s personal wallet.
6. Safety, moderation and international rules
Sumexia GmbH may review, label, restrict or remove content, pause transactions and suspend accounts where proportionate and necessary for safety, fraud prevention, these terms or legal duties. Reports are reviewed by urgency and available evidence; mandatory reporting and disclosure duties are reserved.
Non-consensual intimate images or videos, including digitally created forgeries, are prohibited. Any affected person may report them without a CONE account at info@cone24.com. Where the U.S. TAKE IT DOWN Act applies, validly reported material and known identical copies are removed within the statutory period, generally within 48 hours, and the reporter receives a status update.
Users must comply with applicable export controls, sanctions, embargoes, product restrictions and licensing requirements. This includes Swiss rules and, only where applicable because of a person, good, currency, technology or transaction nexus, foreign rules including U.S. rules.
Where the U.S. INFORM Consumers Act applies to a seller or offer, CONE may collect and verify identity, bank, contact and tax information, require annual certification, make legally required disclosures, and suspend non-cooperating accounts or offers. Users must provide accurate and current information.
7. Availability, warranties and liability
CONE is operated with reasonable care. Uninterrupted, error-free or malware-free availability and successful transactions are not guaranteed. To the extent allowed by law, third-party content, user offers, external services and payment services come without an additional operator warranty.
Nothing in these terms excludes or limits liability where unlawful, including for intent, gross negligence, death or personal injury, fraud, or other mandatory claims. Mandatory product, consumer, privacy and payment-protection rights remain unaffected.
To the extent allowed by law, Sumexia GmbH is not liable for indirect, consequential or punitive loss, lost profit or revenue, lost opportunity, goodwill or data arising from user contracts or third-party content. For business users, aggregate liability for ordinarily negligent, contract-typical loss is limited to the greater of CHF 100 and platform fees paid to Sumexia GmbH in the twelve months before the event.
8. Privacy, electronic communications and changes
Personal data is processed under the Privacy Notice. Legal notices may be sent to info@cone24.com.
Users agree to receive transaction-related notices and confirmations electronically where applicable law permits. Records may be saved or printed. Any mandatory special consent or paper delivery remains unaffected.
Material changes take effect prospectively after reasonable notice, a new version identifier and, where required, fresh express acceptance. Changes do not retroactively rewrite completed user contracts.
9. Governing law and jurisdiction
Unless mandatory law requires otherwise, Swiss law applies and the agreed forum is the ordinary courts at the operator’s registered office in Wohlen, Canton of Aargau, subject to any mandatory statutory forum. For business users, that forum is exclusive.
Mandatory consumer protections and mandatory courts at a consumer’s residence or habitual residence remain fully unaffected. Availability of CONE in the United States neither creates a U.S. establishment nor voluntarily waives objections to personal jurisdiction or venue; mandatory U.S. law and competent authorities’ powers remain reserved.
10. Intellectual property and U.S. notices
CONE, its design and platform components are protected according to the rights that exist in them. These terms grant users no rights beyond the limited right to use the functions provided.
Copyright notices, including notices under the U.S. Digital Millennium Copyright Act, must identify the work, disputed material and exact location, contact details, good-faith statement, statement of accuracy and authority, and a signature, and be sent to info@cone24.com. Affected users may submit a counter-notice where provided by law. U.S. safe-harbor protection is claimed only after all statutory and operational requirements, including a registered agent, repeat-infringer policy and timely handling, are satisfied.
11. Business-user indemnity
To the extent permitted by law, business users indemnify Sumexia GmbH against substantiated third-party claims arising from their offers, products, services, content, taxes, permits, infringements or exceeding organizational authority. This does not apply to the extent the operator intentionally or through gross negligence caused the claim. The operator will provide notice and reasonable participation in the defense; settlements imposing obligations on the operator require its consent.
12. International and U.S. use
Users may use CONE only where, and for offers for which, use is lawful. A language, currency or country selector does not represent that every function or offer is lawful or available in a jurisdiction.
CONE does not adopt users’ statements as its own. Moderating, labeling or removing content does not make Sumexia GmbH its author. Statutory responsibilities and exceptions, including for the operator’s own statements, intellectual property, privacy, federal criminal law or payment conduct, remain unaffected.
13. Termination, transfer, force majeure and severability
Users may end the platform agreement subject to outstanding obligations. Sumexia GmbH may suspend or terminate it for cause, legal violations, safety or payment risks. Accrued rights and payment, evidence and retention duties survive.
Sumexia GmbH may transfer the platform agreement with a business or operating-rights transfer to a successor, provided users’ rights are not unlawfully reduced. Users may transfer accounts or contract positions only with consent or as permitted by law.
Neither party is liable for delay beyond its reasonable control; due payments and mandatory safeguarding duties remain unaffected. Invalid terms are severed to the extent allowed, while the rest remain effective. A waiver in one case is not a continuing waiver.
